Can the insurance company sue us after house fire was concluded accidental and inconclusive?

Hello, we were victims of a house fire that had happened in January. Now my renters insurance is suing my fiancee for the amount they had given me. The main fire marshall of the township ruled the house accidental and inconclusive on what had caused the house fire.

Can they get away with suing us?

This is absolutely ridiculous. The insurance companies “fire investigator” never showed up and got his “facts” from the other insurance company. And is saying that the cause of the fire was completely my fiancee’s fault and that he “purposely” burnt down the house?????

We really need a REAL answer; I think this is completely insane.

If the fire marshals report findings were accidental and inconclusive and the insurance company paid out on a claim, it does not make since why they are now suing you. Do you have a copy of all 3 reports, the marshals and both insurance companies? It seems like there is part of this situation that is missing.

It is normal for insurance companies to share information; it is cost effective and saves time. What I don’t understand is the relation between the insurance company and your fiancée. Is he listed on your renter’s policy? What changed from the time of the payout on the claim to now? What is the basis that the insurance company is now saying the fire was intentional? There is a huge difference between accidental and intentional!

I would think that if the fire were purposely set that your other half would also have some criminal charges being filed against him. Given insurance companies never want to payout, but if the first ins company and the fire marshal don’t see any fault in the case this seems like a situation in which you could fight in court. Don’t let them scare you, call in the fire marshal and other ins companies investigator to testify that the fire was inconclusive or accidental.
